Legal Question in Criminal Law in Illinois

My daughter (21 yrs. old) was arrested in an Illinois Wal-Mart store for shoplifting. It is her 1st offense. She has a good job, same place for 5 years, is a college student and has never done anything like this before. What can she do to keep off her record? Is there a way to keep off the local news blotter? She is very ashamed and wants to do what is right but doesn't want this to follow her into her future. Thank you.

Your daughter needs to hire an attorney. The attorney should be able to keep your daughter from taking a conviction on her record. I do not think that there is much an attorney could do to keep the news item out of the paper.

If your daughter does not have a criminal record, an experienced attorney can likely negotiate for your daughter to complete a theft deterrent program that will result in the prosecutor dismissing your daughter's case. But be careful, even if your daughter is placed on supervision, which is not a conviction, she will have to wait 5 years before getting the case expunged off of her records. Employers will be able to see the arrest when they perform a background check on her.
