disclosure act

what is the disclosure act if a person is incarcerated on a misdeameanor marijuana charge ? i sat in jail for 19 days before a court date on a felony bond when the state knew within 5 working days my felony was a misdeameanor. i was arrested for felony weight of marijuana by the time it got tested it was only a misdeameanor and they kept me in jail without notifying me and denied me bond when it went to bond court 19 days later.

Re: disclosure act

I have been a criminal defense attorney in Illinois for 29 years and never heard of a "disclosure act." What happened to you is not unusual. The police routinely hike the weight of the contraband upwards to effect the setting of bond. The fact that you spent time in jail for 19 days, if your facts are right, before you were taken before a judge may be something that a lawyer could do something about. Good luck.
