Legal Question in Criminal Law in Illinois

Domestic Battery & Dui

I was arrested for domestic battery against my wife the night she told me she wanted a divorce. There was no physical contact just destruction to our own property. 7 months later I was arrested for dui, the DA is offering a deal to plead guilty to one or the other and the opposite will be dropped. My attorney advises to have the Dui dropped and plead guilty to domestic. I don't feel comfortable pleading guilty to an act of violence where there was no physical contact which will stay on my record forever. Is he correct that this will not hurt my future. I have never been in trouble before this night. Is there anyway to really clear any of this of my record now.

Re: Domestic Battery & Dui

You have an attorney. You should be discussing this with your attorney. Any advice you receive on an anonymous "posting board" is far inferior to advice you will receive from your attorney. If you question his/her advice, then ask your attorney to explain.
