Legal Question in Criminal Law in Illinois
domestic case in 2 days, please help
the case is this: witness saw me and girlfriend, with blood on face and shirt, exit vehicle. gf fell in grass and witness saw me strike her. i made no statement to police. she told the cops that the blood came from being drunk and walking into a pole or something and refused pictures and statement. witness also said that all this happened with a white van. i have a red truck and still have the blood in my truck from the incident. gf will testify for me that i never struck her or did anything to break the law. can i pass the alleged striking as grabbing money off the ground next to her that she took from me? the witness also refused a signed statement. can i have the witness remarks thrown out because of the vehicle statement being wrong. i have a public defender and he doesnt care to even think of anything but a plea for 26 weeks of domestic violence classes.

If you are unsatisfied with your public defender's representation, you should either discuss that with him or retain a private attorney that you trust.
A witness' observations are admissible and subject to cross examination. A mistake in a statement does not bar its admission.
