Legal Question in Criminal Law in Illinois
Domestic Violence class four felony
I was charged and plead out according to lawyers advice of a class 4 felony DV in cook county Il. I have not been able to get a job in my feild. I would like to clear my record. I no longer live in that state as a matter of fact my probation was transfered to AZ. My GF is active duty military and we move alot. If I hire a lawyer do I have to appear in court? And how do I clear my record and get my rights back so I can move on with my life? What legal documents do I need to file to get this completed? I've also read that NY FL and VA will sometimes clear you from a charge in another state is this possible I'm closer to FL and have family that lives there. If anybody can help with this information pls. pls. help

It sounds as though it is unlikely that you are eligible for expungement. Few felony convictions in Illinois meet the criteria. There is a great deal of information to be found through links on our website. Go to http://www.shestokas.com/Links.html and click on the link for expungement. There is a great deal of information about the Illinois expungement process there. I am unaware of any process by which an Illinois conviction can be erased by any action in another state. If you do meet the few exceptions to the general rule against felony expungements and wish to discuss your situation, feel free to contact us through our website at http://www.shestokas.com/Ask_an_Attorney.html

If your conviction is more than 5 years old, you may be able to seal your record. This is different than expunging your record. If your conviction is more than 5 years old, please call for more information .
