Legal Question in Criminal Law in Illinois

Domestic violence and harassment

Last August, my ex-husband and I had a domestic dispute that resulted in physical violence. At that time, he attempted to arrest me for domestic violence. I hired an attorney, answered the polices questions, paid for damages to property.

Recently, I made the mistake of calling my ex- on the phone. I recently found out that I had a recurrance of cancer that I had had when we were still married. I called him, and very nicely told him about it, and explained that I just wanted to talk with him since only he knew what I had gone through the last time with my cancer. I apologized for what had happened last August. I asked him a few times if he wanted to get off the phone, and he didn't indicate that he did. We talked briefly for about 10 min., and then his new girlfriend got on the phone and started calling me names and telling me to get over it that I was just going to die. I again asked my ex-husband if he wanted to get off of the phone, and he indicated that it was probably best. I said goodbye and hung up politely.

I am feeling concerned that he may try to have me arrested again, either for domestic violence or harassment. Do you think that the police would arrest me? Does he have a case against me?

Re: Domestic violence and harassment

Not unless there was an order of protection against you. If you violate such an order, there can be repurcussions, however, I do not think it should happen in your case. Anybody can file a complaint with the police - whether it is considered legit is another story. I am sorry for your troubles.
