Domestic violence
Hi i would like to know if the person who has hit his girlfriend and the girlfriends mom would go to jail?

If there are charges of domestic battery filed, the law requires that person to go before a judge for a bond hearing prior to release. This usually amounts to at least one night in jail. Upon release there is generally a 72 hour no contact order, violation of this order can result in new charges and another stay in jail.
As for the charges, a domestic battery is a class A misdemanor, carrying up to a year in jail, and a fine of up to $2500. The probability of jail depends upon the accused's background, the nature of the battery, if there were injuries and if the alleged victims wish to testify in the case. A conviction for domestic battery can result in a fine of up to $2500 and a year in jail. Sentencing is up to the judge and is determined by the sentencing factors as outlined in the statute. Call or email me if you have more questions.
