Legal Question in Criminal Law in Illinois
double enhacement of a theft
I was arrested for misdemeanor theft. The state then enhanced it to a felony theft. Then they enhanced the class 4 felony theft to 1-6 years from 1-3 years max. I have two prior convictions of forgery, not theft. I know it can be enhanced once, but is twice double jeopardy. My attorney is not helping me, and I can't afford to lose my life and everything I have over a lighter. Please help. Thank you.

If you have an attorney you should be discussing all of this with your attorney. If you are not satisfied with your attorney, then you can terminate the relationship with that attorney and hire someone else.

There are rules against double enhancement. Perhaps your lawyer should look at the case law rejecting double enhancement regarding armed violence.
