Hello. If a person on probation violates probation, the department of
probation will file a violation of probation complaint based upon the defendant testing positive for a controlled substance. The defendant could be sent to the penetentiary to serve time. The amount of the penetentiary sentence usually is within the discretion of the judge. Getting a laywer for representation, in my opinion, is something that is necessary to deal with this situation.
