Legal Question in Criminal Law in Illinois
Drug/alcohol evaluation
my husband got an order of protection against me, anyone can get one easily where i live so he said he was afraid of me. He has had several other OP's on other women i found out. anyway i called him one time, went to jail for it. there were other instances he made stuff up but those were thrown out of court when i proved with my phonebill or whatever. For the one call I made and admitted i did, I got 2 yrs probation, drug and alcohol evaluation. I do not use drugs at all and my husband knows this. he alledges i do but the ''crime'' had nothing to do with drugs or alcohol. so they can do this just because my husband says so?

Re: Drug/alcohol evaluation
If you pleaded guilty to the charge and agreed to go to an evaluation, then you will have to do that. Without knowing the case, it is hard to speculate why the State's Attorney wanted you to do an evaluation. It could be the SA's policy or something in the police report could have made the SA think it was appropriate. For example, if you were drunk when arrested, that could be the reason.
