Dteath Threat

If you tap your home phone and record the conversation between your wife and her lover, whereas the lover saying(laughing):''bring him over, we're gonna throw him off the balcony'', would this be considered an indirect death threat? And would this tape recording be legally admissible in court? What are the consequences for them and would this be considered as conspiracy to injure/kill?

Please help

For a conspiracy there must be 2 elements. 1) 2 or more people agreeing to commit a crime; and, 2)taking a substantial step in the commission of the crime. Neither are present here. However, you may have committed a crime by recording the conversation of 2 other people without their permission. Take my advice and file for divorce. Forget the criminal path.
