Employee Theft

I was employed at a dunkin donuts for about a month and half. I had took $400 from a register, and had never returned to work. My last check that I would have recieved from them exceeded the amount that was stolen, and they never mailed me my check. No charges were ever pressed, and I have no warrant out for my arrest. This happened more than 8 months ago. Now I--name removed--having issues about getting them to mail me my W-2 form, and I contacted them and after several attempts, and being told they would mail it to me, the manager told me I can come up there to get it, but they will not mail it. If I was to go in the store could they still contact the police, and try to have me arrested for re- entering the store?

I do not know why they would be able to have you arrested for entering the store. It is open to the public isn't it? There aren't any restraining orders against you entering the store, are there? If there have been charges brought on the basis of the theft, we could find out whether there is an outstanding warrant for your arrest, and then take care of it. I believe that you should consult with an attorney.
