Legal Question in Criminal Law in Illinois

I think my employer filed charges for embezzlement against me. How do I find out what the charges are and do I get a lawyer to go with me to turn myself in?

If the charges are public, in that you have already been charged, the charges would be with the clerk of the court in the county where the offense occurred and where you have been charged. But if you have not yet been charged there will not be any information with the clerk of court. The police may simply have you arrested and then charge you. I recommended that you discuss your situation with an criminal defense lawyer before proceeding.

I agree. If charges are filed, check the website for the clerk of court in the county in which you have been charged. Also, do not give any statements to any investigator, should one call upon you.

I believe that you should hire the best criminal defense attorney you can afford as soon as possible. If there are charges filed against you, the attorney will find them and advise you on how best to proceed. It may be that the attorney can assist in setting up a voluntary surrender that would greatly reduce the amount of time you will spend in custody. Then, the attorney can investigate the evidence and advise you whether you have any defense to the charge. Also, the attorney can either defend you or negotiate a plea bargain on your behalf. If there are no charges, most attorneys will be honest and refund any amount of the retainer fee that was not earned.
