Expunge a felony record
My Fiance has a felony record from over ten years ago. It was a drug charge in Chicago, Illinois. Is there any way he can go about getting his record expunged since this happened so long ago? And if so, how does he go about doing this?

Certain felony drug convictions may be expunged depending on the disposition of the case, in other words, depending on what type of "punishment" was given to the Defendant. If he was convicted and received probation and it has been 5 years since the end date of the probation period, he can expunge a conviction if he was charged under the Cannabis Control Act, Control Substance Act, Steriod Act, or Alcohol and Drug Dependecy Act if he was a first-time offender generally. Your fiance may be able to expunge his record depending upon the statute he was sentenced under. However, he may be able to seal his record. The difference is that only law enforcement will have access to his record, and not private parties. Please call for a free consultation.
