Legal Question in Criminal Law in Illinois
Expunged record showing up in newspaper archive
I was arrested for a battery charge in September of 2001, and had the charges dropped in June 2002. I had the record expunged (by an attorney) in 2004. When I did a google news archive search on my name, It immediately pulled up an old public record that the newspaper (the daily herald) ran when it listed open court calls. It doesn't do that anymore. Is there anyway I can get this out of the public archive? Can I fax the webmaster a copy of my expungement? I have been trying to contact my attorney who handled this but he is not getting back to me. It is so frustrating! Thank you for any help you can guide me with.

Re: Expunged record showing up in newspaper archive
Your expungement only orders the courts and police authorities to remove your records. You can't order a newspaper to remove it's news story about you because of the first amendment.
