Legal Question in Criminal Law in Illinois

Expungement of dismissed charges - Illinois

I was the victim of a crime, the offender was arrested, convicted of battery and sentenced to probation.

However, the defense attorney's previous strategy was to file a frivolous cross-complaint claiming that it was a situation of mutual combat, and therefore I also had to respond to a summons on the charge of battery.

So although the frivolous complaint was dismissed, my understanding is that there will still exist a court record of the fact that I had to appear in response to these false charges. What is the procedure in Illinois to have this record expunged? Thank you.

A petition to expunge must be filed with the appropriate documentation. Then a court hearing is involved. Please call for further discussion on this subject.
