Legal Question in Criminal Law in Illinois
Expunging a misdemeanor record?
About four years ago, I was arrested and charged with a misdemeanor, petty larceny, and served a year and a half of probation. I've been absolutely and totally clean since then (I regard it as just one major bout of stupidity that will never happen again), but am worried that the record is possibly causing problems in seeking a new job. What is the time delay between receiving a sentence and being able to petition for having the record expunged? I thought it was five years, but I'm not sure. And is that five years from the trial date, or five years from the end of the probation period? Any assistance will be much appreciated.
