Legal Question in Criminal Law in Illinois
False personation of a teacher
I am a principal at a high school. A student created a website for a specific teacher without their permission and made some inappropriate comments The student has received discipline at school. However, the parents are concerned about the possibility of the teacher pressing criminal charges against their juvenile son even though she currently says that she will not do that. False personation of a public employee is a Class B Misdemeanor in Illinois. Is there a statute of limitations for filing this type of charge? Please help! Thank you.

Re: False personation of a teacher
Hello. The student is a juvenile, assuming he/she is under the age of 17. Clearly this would be a juvenile court matter if the teacher
decides to go the the State's Attorney. The
State's Attorney's office in all probabilty
will want to see a police report on the incident.
If the teacher has not filed a report within
30 days of the incident, a police department
may be lessly likely to file one on the teacher's
behalf. The issue of whether there is a statute
of limitations here does not really apply since
the student is a minor. In other words, if the
teacher does not press charges now, she cannot
wait until he/she is of age and then try to
have him/her prosecuted as an adult. Will be
happy to answer any additional questions that you
might have. I hope my response has been helpful.
