Legal Question in Criminal Law in Illinois

Falsely arrested

In 1992, I was falsely arrested by a cop and accused of solicting him. I went to court to fight the case, but was given probation. I put in a complaint, but do not know whatever happen to the case. I left it alone thinking that it would be dropped since it was only probation. Now in 2007, my husband and i are trying to adopt and found while in the homestudy that the case is still showing pending in the system with no dates, just a question mark. the adoption agency is telling me that i will not be able to adopt unless this matter is resolve. My question is: how can i fight something that i did not do, but now its 2007. I do not have much to show proof, but my word and a letter of complaint to the police station? I am not certain if going to court would be the best route or expunging the case?

Re: Falsely arrested

Hello. This certainly needs to be cleared up. You need a lawyer to search for the file, regardless of what the clerk's office says. The actual case file should exists somewhere. The file is the key to this problem. I will be happy to answer any additional questions you may have.
