Re: fauliar to appear

From the facts you state in your question it does not appear the your boyfriend is facing any felony charge. Upon his missing the initial court appearance several different things could have happened, depending upon where he was supposed to be in court. In some jurisdictions, the clerk sends a notice to the defendant's last known address giving him a new court date. In other jurisdictions, the court enters and Order basically convicting the defendant of the original charge, forfeiting any bond that was posted, and issuing a warrant for the arrest of the defendant. This warrant will be entered into one or several different data basis, so that any police officer who pulls your boyfriend over, anywhere, will have access to the data base, see the warrant and have the authority to place your boyfriend under arrest and take him into custody. This can get very complicated, unpleasant and expensive. But, all is not lost. If your boyfriend hires an attorney, it is likely that any damage that has been done can be reversed. Depending upon the circumstances it may still be possible for him to avoid arrest, and also avoid a conviction for driving while suspended. It is crucial that he contact and hire an attorney right away.
