Legal Question in Criminal Law in Illinois

felony

My son has 2 felony's from his late teens due to drugs.. this is 20 + years ago.. he has a hard time getting employment due to the felony's can he get these removed. He now is a respectable Citizen and has learn a very hard lesson.

You state your son has two felonies. If they are felony arrests but not convictions they can easily be expunged, assuming no other arrests. If they are straight convictions your son can file a petition for clemency to the governor.

It will depend upon the exact nature of the cases, whether he received supervision/conviction, etc. He should contact the State's Attorney's Office and/or the circuit clerk's office of the jurisdiction where these occurred to see whether or not he'd be eligible to apply for expungement on each. If so, he'll need to fill out the application, get documentation from the arresting agency and/or court, and seek "approval" through notice to the arresting agency, as well. This could take some time, but it may well be worth it if he is having continuing difficulties with employment. Note, however, that in some employment situations, he may still need to disclose the convictions. Best of luck to him.
