Legal Question in Criminal Law in Illinois

how to file a petition for expungment

I accepted a plea bargain for a misdemeanor charge of retail theft in 1990 in Illinois. I have not been arrested since. How do I file a petition to get my record expunged? Is there a charge? I no longer live in IL, so dropping by the courthouse is not feasible. Thanks for your help.

What county were you arrested in? You do not need to personally appear to file the petition.

Unfortunately, a trip to the courthouse is required. You will need to file a petition to expunge with the clerk of the court in the county where your arrest was made. However, if you have a conviction, you will not be able to unexpunge it unless receiving a pardon from the prison board. If you have any more questions, you can email me. Good luck.
