Legal Question in Criminal Law in Illinois
Filing an appeal
I used to work for the Illinois Department of Corrections. In Sept of 2005 I was arrested and charged with Custodial Sexual Misconduct. I was sentenced in March of 2007. I was sentenced to 24 months of probation and placed on the sex registery, the inmate that I had the relationship was the same age as myself. My attorney I had told me that he was going to file an appeal on the sex registery part of the sentencing. I recently found out that my attorney did not file the appeal. Do I have any rights or is there anything that I can do?

Obviously, specific dates are critical to responds to your question. If you want to discuss the specific facts of you case please call. As an aside, I was the lead prosecutor for the Illinois Attorney General prosecution of IDOC guard who were having inappropriate relationships with inmates at Dwight, which lead to the enactment of the custodial sexual misconduct statute.
