Legal Question in Criminal Law in Illinois
grab phone out of conservation officers hand (did not hurt him) and tost it in the back of his truck (did not hurt phone) i told him to call the police now. well he is now going to have me charged with aggravated battery how is that posible?

You've been charged with an aggravated battery for the harmful or offensive contact you made with a protected class of person (conservation officer). If the phone was in his hand and you grabbed it from him, the complaint will allege you made contact of an offensive nature against him. It is similar to knocking a tray out of someone's hand. While you did not make offensive contact with the person, you did make offensive contact with an extension of that person.
Since he is an officer, he is considered part of a protected class which makes a misdemeanor offense a felony.

Perhaps you will think twice before acting like this with a law enforcement officer in the future. What were you thinking? True, an attorney may be able to help you ith the charge, but what can your attorney even say in your defense?
