Legal Question in Criminal Law in Illinois
With held of Adjuication
I was arrested in Fl & received a with held of adjudication on a felony (1st offense, nothing else on mt record). The judge put me on early termination probation and sent me back to my home state. When I fill out job apps. I was told by the public defender (PD) to check ''No'' if it states ''have you ever been convicted of a felony�. The PD states I was never convicted, I am so confused on what to do, b/c the wording of some apps are misleading, they put in parentheses (have ever pleaded guilty, no contest etc.) Questions like this, ''Have you ever been convicted of pled guilty or nolo contendere (''no contest'') in a domestic, foreign, or military court to any felony'' scares me b/c I want the job but I don't want to lie...What should I do?

It seems simple to me, although this is not the answer that you want to hear. In order to get the deal you got, you pead guilty. So, to be honest, you must say so on the application. If you choose not to be honest it is likely that whoever is taking the application will run a check and find the record of your plea.
