Legal Question in Criminal Law in Illinois
Hi
I live in the state of Illinois. My 14 year old daughter was subpoenaed to testify against her step-father. He has several charges ranging from sexual abuse to sexual assault. (non-predatory). Can she choose not to testify? If so can she be held in contempt, what could the state do to her or myself(mom) if she chooses not to testify.

It's not for you to question the validity of the subpoena. That job belongs to your husband's lawyer. Your daughter need only show up on the day in question. If dad doesn't want her to testify, then he can object to her appearance at that time.
