I think straight possession of xanax is a class 4 felony, so you could spend up to 3 years in prison. Possession of drug paraphernalia is a class a misdemeanor for which you could spend up to 364 days in county jail. If you're found guilty of both, the judge would probably run the sentences concurrently (together). If you're a first offender it's possible to get 1410 probation. That's under sec. 1410 of the criminal code where you could expunge your record if probation is completed successfully. With all of this possible, I'd get an experienced criminal defense lawyer if I were you. Your future and freedom are at stake. A felony record can hurt you in many ways, long after your sentence is over. Job opportunities, and even getting into college will become more difficult. Call an EXPERIENCED criminal defense lawyer today.
I totally agree with the above response, and I would add that you need to hire the very best criminal defense attorney that you can afford in the judicial circuit where you have these charges against you. I would imagine that the above attorney might be available if your charges are in Cook County, since his office is in Chicago. If your case(s) are downstate however, you may be better off with a more local attorney. I have criminal defense experience in many different circuits thoughout Illinois, from Springfield to Effingham to Marion. so, I might be able to offer my services to you if your case(s) is in a circuit where I have experience. Please feel free to contact me. Good luck.
