hit and run

i was a victim of ahit and run in 12/09. is this not considered a crime? i did not sustain grave injuries but did have a busted lip and recurrent back pain. now i have fear when driving, particularly when i am alone in the vehicle at night and also have developed a persistent fear of being rear ended. the driver of the hit and run vehicle was located and my insurance did pay for the damage to my vehicle and my health insurance paid for my ER visit. Can I sue the driver or his auto insurance company for that money plus my lost days wages and emotional distress?

Yes, you can sue for property, and personal injury damages. Also, did you have uninsured motorist coverage? If you did, then under some circumstances (e.g.the offender not having insurance) your insurance company is responsible for paying you personal injury damages. See a personal injury attorney pronto!
