Legal Question in Criminal Law in Illinois

home raid & waitting weeks for arrest

Our home was raided by county police 6 weeks ago. The police took electronics and 1/2 oz of pot from husband and few dime bags from son which they said is ''intent to deliver'' cuz they are in separate bags. When they left our house, they said we would be called at a later date to come into station for the arrest of my husband and son. They want time to see if any of the electronics are stolen. They want time to add to charges I guess to try to make a misdemeanor to a felony. Well its been just over 6 weeks ago. Is there a time limit, or can they wait as long as they want and even arrest my family after months or years??? I don't want to ask the police as that might make them rush to do it soon. Thank you.

Re: home raid & waitting weeks for arrest

The statute of limitations for a misdemanor is 18 months,it's 36 months for most felonies, from the date the crime occurs. My advice is to contact an EXPERIENCED criminal defense attorney. I'm in Chicago. If that is close enough to you, please call for an appointment. I've been a criminal defense lawyer for 28 years. I do travel to surrounding counties.
