We really can't answer your question, but either the cop who wrote you the ticket saw it that way or someone else reported it that way. In any event, you need to hire an attorney to represent you so that you do not take a conviction. It is especially important in a case with an accident since the other party will be able to use a conviction against you in any civil action for damges or injuries if you are foolish enough to take the conviction.
