Indictment

1) how long can the district attorney keep you locked up in jail without formally indicting you? (Note) My son-in-law was arrested for trafficking. Because there was no probable cause, we filed a motion to suppress evidence, even though the Judge agreed with our attorney's case file in favor of suppressing evidence he still denied the motion. In an agreement prepared by the DA's office, one of the terms presented was for my son-in-law to waive his 4th ammendment rights? 2) Why would they ask him to do this if they so call have a strong case against him? 3) I'm a single mom, where could I go online line to learn more about probable cause, my son-in-law's right as an alleged drug trafficker? 4)

Assuming that your son-in-law is facing charges in Illinois. It appears from your question that he has already been indicted, that a motion to suppress was denied, that the state offered a negotiated plea and that part of that deal he will waive his 5Th amendment right and testify against others. You can find more information on probable cause and other legal issue at many website or at a library.
