Legal Question in Criminal Law in Illinois

Indited on landlords crime

I have been indited on class x,1,2 & 4 felony drug charges stemming from my landlords possention and pot grow room. There is no lease between us and I have a lease for a different address when arrested and my only link to that address is my mail is sent there and I sleep there 3-4 days a week to commute to work. I currently have the same lawer as the landlord with the attorney stating that there he can represent both until a conflict arises. I have my first court date after inditment 7-11-06. what do I have to do to get this gone ASAP I already have been turned down for jobs based on these pending charges, how soon can the lawer ask for the charges to be dropped. I had no knowledge of involvement in any of this, please help.

Re: Indited on landlords crime

From your comments, it appears that you, at a minimum have a potential conflict with your co-defendant. You should discuss this with an attorney who can advise you.

It sounds as though there really may exist a conflict between you and the landlord. Basically your defense is that the landlord is guilty and you are not. It appears difficult to understand that there is not a conflict.

As a practical matter, once there has been an indictment, it is very unusual for charges to be dismissed quickly. At a minimum your lawyer will need time to review the information the state will provide on your first court date, and plan a strategy following. While he can ask to have the charges dropped immediately, it is unlikely to happen unless he presents the state's attorney with a good legal reason to do so. If you wish to consult further, you may e-mail me [email protected] or the e-mail address attached to this answer. Good Luck.
