Juvennile retail theft. Can parents be fined?

My daughter was caught stealing make-up (worth 5.99)from a grocery store. The grocery store wants us (the parents)to pay them 100.00 as restitution. They say state law permits them to do this. Do we have to pay these people? No conviction in court yet.

Something is not right with this picture. Normally, a "victim" can not demand more than their actual damages as "restitution" in conjunction with a criminal case. The store could of course file a civil suit and ask for whatever damages they might be able to prove up in court. Your daughter obviously needs representation. I would strongly suggest allowing her attorney to deal with the store and the state's attorney's offcie.
