Legal Question in Criminal Law in Illinois

Cant get a lawyer to touch this case !!!

When we bought our home 17 yrs ago we were told to hook up to city sewer in 30 days. we hired a contractor, got the permits, the work was done, the county inspector looked at it and signed off on it as being done properly. Ever since we been paying a sewer bill each month. All of a sudden our toilets started backing up in the house, we tryed rodding the pipes, we even dug up our asphalt driveway to see if pipe was broken. We only found our sink drain pipes leading to city hookup. We then noticed sewage comming up near garage, we dug that up found a huge tank ! We were never hooked up! My back yard has been unusable for 17 yrs due to flooding and the smell. Sewage was draining there the whole time. we asked the county to test water years ago, they told us it was run off rain water, it smelled because it was stagnant. We have damaged carpet, damaged wood floors, our driveway is ruined, we suffered for three weeks cleaning up sewage in our home, we called two attorneys told the secretary the problem, no one will return our call. Can we get our money back for paying 17 years on a service we never had ? What about liability to the county for passing the inspection? and the contractor we paid for the job. what can we do about all this?

Dear Friend -

Greetings! Your case has great potential. In

my opinion, you have a lawsuit against the county

and the contractor. Now the first concern I have is whether the statute of limitations for

this type of claim has run out or whether the

statute of limitations was tolled (stopped from

running) during the time period that you were

unaware of this horrible error which could only

be the result of negligence on the part of the

county and the contractor!. Time is of the

essence. As in any case, a lot will depend on

the facts and the evidence that has survived for

those 17 years. Assuming the statute of limitations has been tolled, you should get started soon. I will be more than happy to answer any additional questions that you have.
