Legal Question in Criminal Law in Illinois
Hello ,
What legal actions can I take against someone who has damaged my personal property twice? I have a witness who saw this person commit the criminal act the second time. I have tried to get a summons for a warrant of this persons arrest and it was denied by a judge. This person is following me and I feel unsafe.
-Thanks!

What is your goal? A restraining order, or a lawsuit for damages to the property, or both? The same act can be both criminal and civil. On the criminal side you can report it to the police, and it would be a good idea to have your witness available. You can also apply for a restraining order and again having the witness available is a good idea. On the civil side, you can sue for damages and, yes, having a witness is a good thing.
