Minor Drinking

Hi. I recently recieved one year probation for minor drinking. Shortly after I was again charged with minor drinking. What will my punishment be and is there anyway of fighting/dismissing this with a lawyer? This took place at a house where the police crawled in through a window without a warrant. I thought this was illegal. There were many other people charged with the same crime so they would also be very interested in this. An officer told many people there that ''The door was locked, good thing there was an open window I could get through.'' I thought this was illegal but maybe not. Thanks for your help.

You asked several questions. First, the police need probable cause to search and a warrant under most circumstances. Second if you are convicted you punishment will be determined by the court. Under the facts given it may be possible to quash the arrest and have the case dismissed.
