Minors questioned by police
In the state of Illinois can a minor be questioned by police without a guardian present?The minor is questioned as a suspect and not a witness.

Generally, the police should contact the child's guardian, prior to questioning the child. If the law enforcement officer knows the law, then he or she will act appropriately and contact the parent. Now of course this does not always happen and at times that will jeopardize the case as far as the prosecutor's attempt to prosecute the minor. That has been my experience for 23 years as an Illinois Defense Attorney in cases where I have gotten the court to dismiss the charge.
