Legal Question in Criminal Law in Illinois
misdemeanor bench warrant
I was arrested in 1997 for simple misdemeanor battery, placed on probation for 10 months, and did not complete my probation. A bench warrant was issued by the presiding Judge, eleven years ago. I need to apply for an Illinois I. D. card, and when I go to the Secretary of State building to get my new Illinois I. D. will I be arrested at that time on the warrant or is there a statute of limitation? Please give me some advice as to where I stand. Thank you.

There is no statute of limitations on a warrant. It will remain until you do something affirmative to clear it, or you are arrested. Mostly, people with warrants are arrested during minor traffic offenses. Please call for a free consultation.
