Re: Is a misdemeanor a criminal offense?
Yes, there are several differences between a felony and a misdemeanor, mainly related to the nature of the punishment, but if someone has a misdemeanor arrest or conviction on their background and nothing else, they are considered to have a criminal history. The limits on punishment for a misdemeanor are no more than 364 days in a county jail. Felonies begin with a minimum of one year in a state prison. (There are lesser penalties like probation for the felony, but that remains a felony conviction and while on probation the possibility of a year in prison remains. )
