Legal Question in Criminal Law in Illinois
misdemeanor espungemnet
In 2003 I was convicted of a misdemeanor theft. I was given 1yr probation which I completed in sept 2004. I was told that I had to wait 4yrs from the end of my probation to get it espunged. In 2007 I was taken in for driving on a suspended license for a ticket that I had gone to court on and paid a $90 fine on. Is it true that now I have to wait 4 more years to get my record espunged because of this last incident?

No, the waiting time is for the original case. You may have a problem though as a result of your new arrest. It depends on what happened with your suspended license matter. I have several websites to recommend to assist you in these matters. Re: misdemeanor espungemnet
David Shestokas gave you good information. However, if your sentence was probation you will not be able to expunge it. I'm assuming that you received a sentence of supervision. If you receive a conviction on this new case, instead of supervision, you will not be able to expunge anything. Good luck.
