Money loaned
My daughter loaned her boyfriend 2000.00 to help him buy a car. Of course, no signed contract. The car has been seized due to drug charges. My daughter had no clue of the dealings. Now she would like to get the car to sell and recoup her money. His boyfriend's parents also loaned him money and would like to get the car back from impound. Any advise would be appreciated. If the car was seized in conjunction with a state prosecution, it may be possible for the innocent parties to file a Petition under the statute (CAFA) and, depending upon the prosecutor and the judge, they might obtain some relief. These cases are very fact specific and also results vary greatly from jurisdiction to jurisdiction. There is a similar procedure if this involves Federal charges, but I can tell you that the Fed.s very rarely fgive up aything that they seize. Good luck.
