motion to dismiss a case
if you put in a motion to dismiss a case due to insufficient evidence, can te judge grant the motion at the hearing or does the state have a time frame to answer to it?

Usually the judge will give the State time to answer such a motion. Occasionally, a judge may dismiss right away or order the defendant released pending further proceedings.
