Legal Question in Criminal Law in Illinois

obstructing a peace officer ch720act5 sec/par31-1

I was asked to leave a bar for no reason. I was talking to a friend and was going to ask him for a ride to a friends. The bar was getting ready to close. The bar worker called the local cop to come ask me to leave.(for no apparent reason) I was not violent or obscene. I was minding my own business talking to a friend. When the local officer came to ask me to leave I asked him to check to see if my cell phone might of fell out of my pocket of my jacket. He threw me up against the car and told me I was being arrested. I never said a word. When arriving at the jail the bailer said I was charged with obstructing a peace officer. What are my options with this charge I have received.

Your options come down to this: hire a lawyer. Not a cheap lawyer who will only plead you guilty. They will tell you that you will end up without a record. That's because they will cut a deal for "court supervision" which is not a conviction. You can expunge that 2 years after the supervision is over. The catch is, you have to plead guilty. Get a lawyer who will fight this case. To obstruct a peace officer you must do something that prevents the officer from completing his arrest. The fact that you didn't follow his orders immediately is not obstructing. You can't count on the state's attorney to do the right thing because they, for all practical purposes, represent the police. Please call me immediately for an appointment.
