Legal Question in Criminal Law in Illinois
Order of Protection Violations
Can the Petitioner be arrested or charged with a crime if the Petitioner contacts the Defendant by telephone? What if the Defendant arrives at the home of a mutual friend while the Petitioner is present, and the Petitioner does not leave, and they have conversation without confrontation?

Re: Order of Protection Violations
Hello. If the petitioner contacts the respondent
with an order of protection in place, a police
officer in 99% of the cases will not arrest the
petitioner even if he knows that the petitioner
initiated the contact. If the petitioner and
the respondent happen to meet and spend time
together without incident, fine, but the respondent always is at risk in these situations
for obvious reasons. I hope my answer helps.
Good Luck!
