Outstanding Bench Warrant

My fiance was charged with theft of less than $300 dollars in spring of 05, b/c of his immigration status he moves a lot. He did not steal any money, it was a former employer trying to get even with him for leaving without notice. Anyway, neither the restaurant owner who charged him, nor my husband showed up at the court date.(Almost 2 years ago). We are only aware of the warrant b/c we were trying to find dates of his DUI's for our pending immigration case. This complicates matters a great deal. I contacted the restaurant owner who thought that b/c of his absence at the court date, the charges were dropped. They are willing to drop the charges. The clerk of court recommends that my husband present himself at any U.S. Jail and give his info. date of birth and pay the bail. However, wouldn't that mean they would arrest him & put him in jail? How do I proceed? He never received the order to appear in court.

This is somewhat common. They want him to come in and they will arrest him, after which he can post bond. Contact my office before he goes.
