Legal Question in Criminal Law in Illinois

Past retail theft?

Hi, I live in IL. Back in October I took a vacume from a bed bath and beyond and walked out with it. Was stupid I know but it happened. I wanted to get rid of it cause i never used it so yesterday I went back to return it. They told me that they were keeping it after they tried to look up the purchase info because that one was one they had on file as stolen on a certain date. Guess the numbers came up on it. Anyway, they said they had a dectetive working on the case who was going to call me. He hasnt called yet. But they said they have me on tape from that date taking it and walking out. And there was a woman who worked there who was there yesterday also who rememberd me from that day walking out with it cause she was wondering if I paid for it or not but didnt say anything at the time. Anyway, Im wondering if they can arrest me for it after the fact cause they have me on camera from that month and have the merchandise back? Will it hold up in court with an attorney?

Re: Past retail theft?

If the police call you, you should refuse to talk to them. Use your right to remain silent! If you try to talk your way out of trouble, you are going to get yourself into further trouble.

As to the strength of your case, I will not comment on that. There is no way I could form a proper opinion of the case until I had all the discovery (police reports, videos, etc.) in the case.
