Should a person accept a count 4 felony or go to trail and still receive social security benefits if the person is held unfit to stand trail due to mental disorder????

While I cannot speak to whether an individual will still qualify for social security benefits as a result of being found guilty, the issue you've raised can still be answered. You must approach your question in 2 parts. A defendant will be found fit or unfit to stand trial prior to trial.
The second part of your question...if this person is charged with a count 4 felony, the sentencing span is 1-3 years in the department of corrections. What the sentence/offer would be is based on the defendant's background, the circumstances of the case and the lawyers involved.
