Legal Question in Criminal Law in Illinois
plea agreements&sentencing
my son was offered two plea agreements. one was jail time which has not started yet&was knocked down to a misdeamor. The other offer was a felony count but no jail time. He took the jail time offer but now would rather just take the felony count. Do we have 30 days to change this or is it a done deal? The public defender assigned to him will not return my phone calls.

This is probably a done deal. You are unlikely to find grounds to set aside the plea. Also, generally, it is better to enter a plea to a misdemeanor rather than a felony. Your son probably made the right decision.
