Legal Question in Criminal Law in Illinois

Police Blotters

In July of 2006 I had to restrain a 12-year old resident where I was employed as a counselor at a youth residential facility for at-risk boys. Two days later I was arrested on the charge of Battery against this particular young man. On February 25, 2008 I went to court and the case was FINALLY dismissed. I am currently working with another youth organization on a volunteer basis and Ive applied to work full time, but the problem I have now is that Ive been told that even though the charge was dropped it is still on the police blotter and I need to have it expunged before I can be hired. So my question to you is, what steps do I need to take in order to have this expunged?

Re: Police Blotters

Since the case was dismissed, it is expungeable. This requires petitioning the court where the matter was prosecuted and providing notice to the prosecuting authority, arresting authority and the legal representative of the arresting authority. There are usually fees involved for the Clerk of the Court and the State Police. The Office of the State Appellate Defender has great information about the process. There is a link to that office at our website at http://www.shestokas.com/Links.html Please look under expungements on that page. Good Luck.
