Legal Question in Criminal Law in Illinois
Can a police officer have probable cause to arrest and charge someone with a moving violation based on an uncorroborated 911 call tip if the citizen informant was not anonymous. I know under current caselaw including the case of PRADO NAVARETTE ET AL. v. CALIFORNIA that was decided yesterday a police officer can have a reasonable suspicion to stop someone for drunk driving based on an uncorroborated 911 call tip. However reasonable suspicion does not rise to the level of evidence that allows an arrest to be made and criminal charges to be filed.
